PAYMENTS

You can pay by credit card (MASTERCARD, VISA, VISA ELECTRON, AMEX, DINERS) or PayPal. The entire process takes place via a secure connection directly linked to the banking institution that owns and manages the online payment service, and data is transmitted encrypted using SSL protocol. This protocol guarantees data transmission protection and the protection of all confidential information from decryption and/or tampering.

CREDIT CARD

The data you provide will be collected exclusively by BIGFOOT. Remember that you are solely responsible for the data you enter, so only use credit cards that you have legitimate access to. Payment by credit card may be denied for the following reasons:

- the credit card has expired
- Your credit limit has been reached: Check with your bank to ensure your credit card has not exceeded its maximum amount for purchases. Some information has been entered incorrectly: Check that you have entered all the required fields correctly.

PAYPAL

PayPal is an electronic wallet that allows you to pay and receive money online. To use PayPal, you must register on the official website: registration is simple and free. You can top up your PayPal account with a bank transfer from your current account, or you can link a credit card, prepaid card, or bank account to your account. For more information on this payment method, please visit the PayPal website. If you have an active credit card on your PayPal account, the system allows you to save a unique identification code so you don't have to re-enter your credentials for future payments. The data you provide will be collected exclusively by BIGFOOT and transmitted to PayPal in encrypted form for electronic storage. PayPal will store and process this data independently, according to the highest security standards, and solely to process your purchases on our website www.savemybag.it. You can deactivate the token (saving of your credit card data) at any time by contacting PayPal, or by typing 'Automatic Payments' while logging into your PayPal account (this will take you to the page containing the instructions for canceling an automatic payment).

Klarna: a service that allows you to split the cost of your purchase on our site into 3 equal payments.

SHIPPING

Orders are processed from Monday to Friday, and shipping usually takes place on the business day following payment confirmation.
All payments are subject to random checks by payment circuits: until the checks are completed, the order payment will be temporarily suspended, and we will not be able to proceed with shipping.
Once the order is entrusted to the courier. The courier does not deliver on Saturdays and Sundays.
Orders may experience shipping delays during the following holiday periods: January 1, January 6, Easter and Easter Monday, April 25, May 1, June 2, August 15 week, November 1, December 8, December 25 week, December 31.

Shipping is FREE for orders over €100.00. For orders below this amount, shipping costs €10.00. For most national shipments, savemybag.it delivers within 48 hours of order processing.

For member countries of the European Union, as well as the UK and Switzerland, shipping is free for orders over €150.00. For orders below this amount, shipping costs €25.00 (+% fuel surcharge charged by the courier). savemybag.it will not be responsible for customs duties or taxes for non-EU countries. For all these countries, customs duties or taxes are the responsibility of the customer. savemybag.it delivers to most countries within 2-3 business days.

Rest of the World
savemybag.it delivers to all countries worldwide, ensuring maximum speed and accuracy in shipping. Shipping is free for orders equal to or over €800; for orders below this amount, shipping costs start from €100.00 (+% fuel surcharge charged by the courier). savemybag.it will not be responsible for customs duties or taxes for non-EEC countries. RETURNS

You can return an item within 14 days from the order delivery date. Due to customs regulations, it will not be possible to return goods from a non-EU country unless there are obvious defects or flaws in the product. The right of withdrawal can only be exercised by the customer and in no case by the recipient of a gift. The substantial integrity of the product is an essential condition for exercising the right of withdrawal: items that are used, dirty, damaged as a result of ordinary use, or missing tags and packaging materials will not be refunded. Returns incur a shipping and handling fee of €10 for Italy and €25 (+ % fuel surcharge charged by the courier) for other EU countries, which will be deducted directly at the time of refund. This fee is borne by savemybag.it if the reason for the return is due to any obvious defects and flaws found upon arrival and present on the new and unused product by the buyer.

REFUND METHODS AND TIMELINES

Returned merchandise is delivered to our trusted logistics partner, and the assigned personnel verify returns as quickly as possible. Refund methods and timelines vary, in compliance with legal terms, based on the type of payment chosen for the order:

If you paid by credit card or PayPal, we will issue the refund, reversing the original payment and deducting any return shipping costs – if due, within approximately 7 business days from the date of receipt of the return (it takes approximately 5-6 business days to formally see the refund on the credit card, depending on the contract stipulated with the card issuer).

INSTRUCTIONS FOR RETURN REQUESTS

To make a return request, you can use the appropriate form at this link. Remember that items must be returned intact and in the same condition in which they were received, with tags indicating the barcode and any other seal that is part of the product. Products with a tampered with and/or removed warranty seal cannot be returned and refunded.
We do not currently offer exchanges. However, you can return an item (receiving a refund with the return shipping fee deducted as specified above) and make a new purchase (it is not necessary to wait for the refund to place a new order).

 

TERMS OF SALE

The offer and sale of bags and accessories on the website www.savemybag.it are governed by the following General Conditions of Sale. Products purchased on the website www.savemybag.it are produced, sold, and marked with trademarks owned by BIGFOOT Srl, with registered office in Castel Bolognese (RA), Via Emilia Levante 233, registered in the Ravenna Company Register under No. 181951, VAT No. 02218400394, Share Capital Euro 90,000.00 fully paid (hereinafter "BIGFOOT" or the "Seller" or "we").

1. CONCLUSION OF THE SALES CONTRACT

These General Terms and Conditions of Sale are an integral and essential part of the sales contract with the customer. The customer's electronic submission of an order implies full knowledge of these General Terms and Conditions of Sale and their full acceptance. If the customer does not agree with one or more terms contained in these General Terms and Conditions of Sale, he or she is requested to refrain from making purchases on www.savemybag.it (the "Site").
- To proceed with the purchase of one or more products on the Site, the customer must first register on the Site, providing BIGFOOT, in compliance with the applicable provisions on the protection of personal data, all the data necessary to allow the latter to execute the orders placed.
- To conclude the purchase contract with BIGFOOT, the customer must send BIGFOOT their order following the procedure indicated on the Site. Sending the order electronically creates the customer's obligation to pay the price indicated therein.
- When the customer places an order, they will receive an email from BIGFOOT confirming receipt of the order and a summary of the order. However, this email does not constitute automatic acceptance of the order.
- BIGFOOT reserves the right to refuse orders from customers with whom it is in dispute regarding the payment of a previous order.

2. SELLING PRICES

- All product prices displayed and indicated on the Site include VAT and any other taxes that may be applicable in relation to the sale.
- The cost of shipping and handling, if applicable, will be clearly indicated and displayed before completing the order.
Product prices may be subject to change. The customer is responsible for verifying the final sale price before placing the order. Any obvious material error in the price shown on the Site compared to the commonly known price of the selected product will result in BIGFOOT's right not to confirm shipment and to immediately refund the purchase price paid by the customer, without the customer being able to raise any objections.

3. DELIVERY METHODS

- BIGFOOT will do its best to process orders placed within 7 working days and in any case no later than 30 days from the day following the day on which the customer placed the order.
- The customer is required to verify, upon receipt, that the product delivered to them conforms to the order placed. Only after this verification, and obviously without prejudice to the right of withdrawal provided for in the following point 7, does the customer authorize BIGFOOT to communicate personal information (residence, telephone number) to the couriers and/or shipping agents used to deliver the purchased goods in order to allow the necessary procedures for their delivery.

4. PAYMENT METHODS

- To pay the price of the products and the related shipping and delivery costs, if applicable, the customer can follow one of the methods indicated on the order form.
- For payments by credit card, the payment process will be conducted via a secure connection directly linked to the banking institution that owns and manages the online payment service, which BIGFOOT cannot access. Specifically, financial information (for example, the credit/debit card number or expiration date) will be forwarded, via encrypted protocol, to the providers of the relevant remote electronic payment services, without third parties having any access to it. Furthermore, this information will never be used and/or stored in any format (including electronic) by BIGFOOT. The order amount will be charged the day after the order is placed, subject, of course, to the customer's right to a refund in the event of default by the Seller or failure to execute the contract for any reason.
- The customer is solely responsible for the data entered and therefore guarantees to use only credit cards that are legitimately available to him.
- The customer can pay by bank transfer; the order remains pending until the payment is credited by our bank. Shipping begins on the date the payment is credited.

5. RESPONSIBILITY

- BIGFOOT assumes no responsibility for disruptions attributable to force majeure, such as, for example, accidents, explosions, fires, strikes and/or lockouts, earthquakes, floods, and other similar events that prevent, in whole or in part, the execution of the contract within the agreed timeframe.
- BIGFOOT will not be liable to any party or third party for damages, losses, and costs incurred as a result of failure to perform the contract for the reasons mentioned above. The customer is only entitled to a refund of the price paid.
Likewise, BIGFOOT is not responsible for any fraudulent or illicit use by third parties of credit cards, checks, or other means of payment when paying for purchased products. At no point during the purchase process is BIGFOOT able to access the customer's credit card number, which, through a secure connection, is transmitted directly to the banking service provider.
The essential product characteristics are presented on the Site within each product page. The images and colors of the products offered for sale may, however, differ from the actual colors due to the Internet browser and monitor used.

6. CUSTOMER OBLIGATIONS

- Minors are strictly prohibited from placing an order on the Site.
- The data entered during the purchase process must be your own real personal data and not that of third parties or invented data. BIGFOOT reserves the right to take legal action against any violation or abuse, in the interest and protection of all consumers.
- The customer indemnifies BIGFOOT from any liability arising from the issuance of incorrect tax documents due to errors in the data provided by the customer, being the customer himself solely responsible for their correct entry.

7. RIGHT OF WITHDRAWAL AND REFUNDS

- The customer may exercise the right of withdrawal and return the product received, without penalty and without specifying the reason, in compliance with the terms and conditions set out below.
- The customer can make the return request by sending an email to info@savemybag.it - ​​within fourteen (14) days of receiving the products.
Products must be returned intact, unwashed, and undamaged, with the barcode tags and any other seals attached. Products returned incomplete, ruined, damaged, deteriorated, or soiled will not be refunded. Products with tampered and/or removed warranty seals cannot be returned or refunded.
- The products to be returned must be delivered to the carrier within fourteen (14) days, starting from when the customer communicated to the Seller his decision to withdraw from the contract.
- The costs of returning the Products will be borne by the customer, including liability in the event of loss or damage to the products.
- After the products have been returned, the Seller will carry out the necessary checks regarding their conformity to the conditions and terms indicated in this paragraph.
If the right of withdrawal is exercised according to the methods and terms indicated in this paragraph, BIGFOOT will refund the customer any sums already paid for the purchase of the products. The Seller generally correctly processes the refund using the same payment method used by the customer to purchase the returned products, even if a virtual and/or disposable credit card was used. For legal reasons, the Seller cannot process a refund to a credit card other than the one used for the purchase, except in the case where the credit card has expired in the meantime: in this case, the customer can send an email to info@savemybag.it to agree on the most appropriate refund method.
- Whatever the payment method used by the customer, the refund is activated by the Seller as soon as possible and in any case within fourteen (14) days from the date on which the Seller became aware of the exercise of the right of withdrawal, after verifying the correct execution of the same and checking the returned products.

8. APPLICABLE LAW AND JURISDICTION

Any dispute relating to the application, execution, interpretation, and violation of purchase contracts stipulated through the website www.savemybag.it is subject to Italian law; these general conditions refer, except where expressly provided for therein, to the provisions of the Civil Code and Legislative Decree 205/06 (the "Consumer Code"). The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.
- Any dispute between the parties regarding this contract will be subject to the exclusive jurisdiction of the Court of Ravenna.
- In the event of disputes between the Seller and the customer arising from the General Conditions of Sale, we inform you that the European Commission provides a platform for the alternative extrajudicial resolution of disputes, accessible on the website http://ec.europa.eu/odr.

9. CHANGES AND UPDATES

BIGFOOT reserves the right to modify the Site, its policies, and these Terms and Conditions of Sale at any time to offer new products or services, or to comply with legal or regulatory requirements. Customers who access the Site and place an order will be bound by the policies and terms of the Terms and Conditions of Sale in effect at the time the order is placed, unless any changes are retroactive under applicable law (in which case, they may also apply to orders previously placed by the customer). If any provision of these Terms and Conditions is held to be invalid, void, or for any reason unenforceable, such provision will not affect the validity and enforceability of any other provisions.

GIFT CARD

GENERAL CONDITIONS OF PURCHASE AND USE OF THE GIFT CARD
What is the Gift Card?
The Gift Card is a gift voucher that can be purchased online, by accessing the website www.savemybag.it (hereinafter generally referred to as “Website”) and can be used for personal purchase or to be given as a gift to a third party.
Once the Gift Card purchase procedure is completed, an email will be sent to the recipient ("Beneficiary") indicated by the Buyer at the time of purchase, containing the gift voucher code. The Gift Card can be used immediately by the Beneficiary to purchase only products sold by accessing the Website, without any need for activation of the Gift Card itself, which will be active from the moment the aforementioned email is sent.
The Gift Card is issued and sold by BIGFOOT S.R.L via Emilia Levante n. 233 -48014 Castel Bolognese(ra) Tax Code/VAT Number 02218400394 (hereinafter "Seller").
Bigfoot srl is also the owner of the Website, as well as the Supplier – Manufacturer of the products sold on the Website.
The purchase and use of the Gift Card is governed by the General Conditions of Purchase and Use reported below.
The purchase of products sold by accessing the Website, on the other hand, is governed by the General Conditions of Sale available in the "Terms of Sale" section of the Website. For anything not otherwise established in these General Conditions of Purchase and Use, full reference is made to what is covered by the General Conditions of Sale mentioned above.
How to purchase the Gift Card
The customer who wishes to purchase a Gift Card (hereinafter "Buyer") must proceed by sending a specific electronic purchase order to the Seller, by selecting the Gift Card product and adding it to the cart.
When selecting the Gift Card, the buyer must indicate the value they intend to assign to it, which cannot be less than €50.00 – fifty/00). The value of the Gift Card also constitutes its purchase price.
At the time of purchase, in addition to their personal details and those of the Gift Card recipient, the Buyer must also provide a valid email address for the Beneficiary for sending the Gift Card. It is the Buyer's responsibility to verify that they have entered a valid email address, as no responsibility can be attributed to the Seller if an invalid email address is provided.
To proceed with sending the order, the Customer must click on the "Add to cart" button.
A Gift Card can be purchased using all payment methods provided on the Website.
By sending the order form, the Buyer confirms that they are aware of and have unconditionally accepted the General Conditions of Sale, in addition to the specific General Conditions governing the use and purchase of a Gift Card and the specific Privacy Policy. Before proceeding with sending the order, therefore, the Buyer will be asked to carefully read the General Terms and Conditions of Sale (of which they can print a copy using the print command and/or save them for personal use).
No discounts and/or promotions of any kind can be applied to the purchase of a Gift Card, including any offers and/or promotions present on the Website, which are in any case to be considered valid only for the direct purchase of products sold on the Website.
Upon completion of the purchase, the Gift Card, with the associated gift voucher code, will be sent to the Beneficiary's email address indicated at the time of purchase.
Right of withdrawal
The Buyer, as a consumer pursuant to Legislative Decree no. 206/2005, within 14 (fourteen) days from the purchase of the Gift Card, may exercise the right of withdrawal in the manner best indicated in art. _7_ of the General Conditions of Sale available in the "Terms of Sale" section of the Website, with the exception of what is exclusively valid for withdrawal from the purchase of products other than the Gift Card.
The right of withdrawal regarding the purchase of a Gift Card can only be exercised if the Gift Card has never been used by the Beneficiary.
In the event of exercising the right of withdrawal regarding the purchase of a Gift Card, once the communication of withdrawal has been received and its non-use verified, the Seller will refund the amount paid for the purchase as soon as possible and, in any case, within fourteen (14) days from the date on which the Seller became aware of the withdrawal. The refund will be made using the same payment methods used for the purchase of the Gift Card.
Use of the Gift Card
Once the purchase order is completed, the Buyer will receive an order confirmation email containing the order summary. At the same time, an email will be sent to the Beneficiary of the Gift Card to the email address indicated by the Buyer at the time of purchase, containing the gift voucher code associated with the Gift Card. The Gift Card is immediately functional upon sending and does not require any activation.
The Beneficiary who wishes to proceed with the purchase using the Gift Card must follow the purchase procedure as specified in the General Conditions of Sale available in the "Terms of Sale" section of the Website and, at the time of payment, must choose the "Apply Gift Card" option and then enter the gift voucher code associated with the Gift Card.
The Gift Card can be used multiple times until its value is exhausted and in any case within one year from the date of issue. After each expense, the Gift Card's value will be automatically deducted, until it is completely exhausted.
If the initial or remaining value of the Gift Card is not sufficient to make the desired purchase on the Website, the missing amount can be paid using the additional payment methods provided for purchases on the Website.
The purchase of Products on the Website using a Gift Card is governed by what is provided in the General Conditions of Sale available in the "Terms of Sale" section of the Website.
The Gift Card is intended exclusively for the personal use of the Beneficiary and cannot be commercialized to third parties.
The Gift Card can only be used for the purchase of products sold by accessing the Website; it cannot be used for the purchase of another Gift Card and its value is not convertible into cash.
The Gift Card is a bearer instrument and is equivalent to cash. Therefore, if it is used improperly, lost, stolen and/or damaged, it cannot be blocked and/or replaced and/or refunded. Furthermore, no responsibility can be attributed to the Seller and/or Bigfoot srl for any improper and/or fraudulent use of the Gift Card.
The risk of loss and ownership of the Gift Card, in fact, are transferred to the Buyer and/or the Beneficiary at the time of electronic transmission of the Gift Card to the email address indicated by the Buyer at the time of purchase of the Gift Card itself.
Gift Cards obtained through any fraudulent or illegal means will be considered null and void and, therefore, cannot be used for the purchase of products offered for sale on the Website.
Duration
The Gift Card is active from the date of dispatch to the Beneficiary and is valid for one year. After this period, the Gift Card can no longer be used and any remaining value cannot be further used and/or refunded.
Returns and right of withdrawal for products purchased with the Gift Card
In the event of the Beneficiary exercising the right of withdrawal and therefore returning a product purchased using only a Gift Card, the refund will be made by the Seller issuing a voucher that can be used for subsequent purchases made on the Website, valid for 12 (twelve) months from the date of its issue.
If the withdrawal and return, on the other hand, concern an order paid using an additional payment method in addition to the Gift Card, the refund will be made, for the value of the Gift Card, by the Seller issuing a voucher as specified above and, for the excess amount compared to the value of the Gift Card, using the same payment method chosen by the Beneficiary at the time of purchase.
In this case, if the withdrawal is partial and the return concerns only some of the purchased products, the refund will be executed primarily using the payment method complementary to the Gift Card.
Regarding the methods and terms relating to the exercise of the right of withdrawal and the return of products purchased using a Gift Card, full reference is made to what is provided in art. ___7__ of the General Conditions of Sale available in the "Terms of Sale" section of the Website.
Privacy and Processing of personal data
Pursuant to art. 14 of European Regulation no. 2016/679, Bigfoot srl S.p.A., with registered office in Milan (MI), via Durini 24, 20122, in its capacity as "Data Controller" informs you that the personal data provided by a third party for the use of "gift card" services will be processed in accordance with the provisions of this information.
The origin of the processing is to be identified in the signing of a so-called "contract in favor of a third party" (regulated by articles 1411, 1412 and 1413 of the Civil Code) in which the recipient of the "gift card" has been identified by the stipulator as the subject to whom the agreed service/good is to be provided by the promisor (provider of the "gift card").
The Data Controller has appointed a Data Protection Officer (DPO). The Data Controller and the DPO can be contacted at the registered office or by writing to the email address __privacy@bigfootsrl.it__
Personal data (name and email address of the gift card recipient), collected through the gift card buyer, are processed and used exclusively for the purpose of sending and using the "gift card". The legal basis for data processing lies in art. 6, 1 letter b) of European Regulation no. 2016/679 (processing is necessary for the performance of a contract to which the data subject is party).
The data is processed using predominantly IT and/or telematic methods and with organizational and logical methods strictly related to the pursuit of the purposes indicated in this information, adopting security measures to minimize the risks of destruction or loss, even accidental, of the data itself, of unauthorized access or of processing not permitted or not compliant with the collection purposes indicated in this information.
The collected data is kept for the time necessary for the delivery and use of the gift card, then for the time required by tax legislation regarding contracts it will be archived and processed only in case of controls and verifications, also by the competent Authorities.
The data will not be disclosed in any way and may be known by the following categories of subjects: (i) employees and consultants of the Data Controller, duly authorized by the same for processing and instructed for this purpose; (ii) service providers, appointed by the Data Controller as data processors; (iii) public or private subjects who can access Personal Data by virtue of legal provisions, regulations or community legislation, within the limits provided by these rules.
As a data subject, you are recognized the following rights: (a) access your personal data; (b) obtain the rectification and updating of the data, request the limitation of the processing carried out on your data (including, where possible, the right to be forgotten and erasure); (c) object for legitimate purposes to data processing as well as exercise your right to data portability, where possible. It is also recalled that it is always possible to lodge a complaint with the Supervisory Authority (for Italy, Garante per la Protezione dei Dati Personali, Rome; website www.gpdp.it or www.garanteprivacy.it, email protocollo@gpdp.it, PEC protocollo@pec.gpdp.it).

In the event of any malfunctions of the Gift Card, the Buyer or Beneficiary must notify promptly and, in any case, within the legal terms provided for the legal guarantee of conformity, by contacting Customer Service at the email address or telephone number indicated above.
Applicable Law and online dispute resolution with the consumer and competent court
For the applicable law, the online resolution of any disputes arising with the consumer and the competent court, please refer to what is better specified in art. __8__ of the General Conditions of Sale available in the "Terms of Sale" section of the Website.
